GENERAL CONDITIONS
1 Definitions
"Agreement" - refers to the agreement entered into between Palmyra Clinic and the Patient, which consists of Service-Specific Terms and General Terms and Conditions.
"General terms and conditions" - refers to these general terms and conditions.
"Service-specific conditions" - refers to the specific conditions for the ordered service.
"Palmyra Klinik" - Palmyra AB org. no. 559463-8057 ("Palmyra Clinic") is a registered healthcare provider that is under the supervision of the Inspectorate for Care and Care (IVO).
"The Service" - refers to the medical service(s) ordered by the Patient and defined in the Service-Specific Terms.
"The patient" - refers to the natural person who, as a patient, has ordered the Service.
2 Parties
Parties to the Agreement are the Patient and Palmyra Clinic.
3 APPLICABILITY
3.1 Service-specific Terms and General Terms and Conditions apply between Palmyra Klinik and the Patient for each order of Service and must be approved by the Patient before Palmyra Klinik can start performing the Service.
4 Scope
4.1 General
4.1.1 Palmyra Clinic is a private clinic and not an emergency care clinic or primary care clinic. For emergency care, always contact SOS 112 or visit the emergency department. For matters related to primary care, contact your GP or health centre.
4.1.2 The patient can only use Palmyra Klinik's services for their own health improvement and for the intended purpose of the Service.
4.1.3 Palmyra Klinik has the right to interrupt the provision of the Service if Palmyra Klinik makes the assessment that Palmyra Klinik does not have the conditions to help the Patient to a sufficient degree. In the event of such interruption of the Service, Palmyra Klinik will refund an amount corresponding to the remaining treatment time in the case of advance payment and in the case of ongoing monthly payment, the Patient's payment responsibility for future payments shall cease.
4.1.4 The Service entitles you to use Palmyra Klinik's App and the digital services that follow from the Service. The service is personal and cannot be transferred. Access to Palmyra Klinik's App requires personal login with BankID. In the event that the Service-Specific Terms and Conditions specify an age limit, that age limit shall take precedence over the General Terms and Conditions.
4.1.5 Palmyra Klinik shall perform the Service in a professional and professionally correct and ethical manner.
4.2 Clinical Services
4.2.1 All clinical services are provided in accordance with the laws and regulations that apply to healthcare in Sweden.
4.2.2 Palmyra Klinik's staff must follow the Medical Association's ethical rules when performing the Service.
4.2.3 Clinical services are provided according to Service-specific conditions, as well as in accordance with what was agreed with the attending physician.
4.2.4 The patient is responsible for following, to the best of their ability, the treatment plan drawn up in consultation with their doctor, in order to optimize the possibility of, with the help of their care team, reaching desired health goals.
4.2.5 The patient himself is responsible for the implementation of changes in lifestyle, diet and habits and influences through this, as well as through the collaboration with Palmyra Klinik's nursing staff who support through the change, what effect will be achieved.
4.2.6 The patient is obliged to inform Palmyra Klinik about all medicines and dietary supplements that the patient takes, about what other treatments the patient has undergone or is undergoing, as well as answer truthfully in the health form and, if necessary, supplement previously provided information about changes or new information. The patient is also obliged to inform Palmyra Klinik about steady deterioration of the patient's health condition.
4.3 Digital Services
4.3.1 Apps, Devices and Software
4.3.1.1 Palmyra Klinik will make reasonable efforts to ensure that the digital services are accessible and appropriate in terms of content.
4.3.1.2 Palmyra Klinik reserves the right to temporarily suspend the digital services for technical maintenance. Palmyra Klinik intends to plan such maintenance so that the impact on the patient is reduced. The digital services may suffer from technical interruptions that are both within and outside of Palmyra Klinik's control. Palmyra Klinik will always use reasonable efforts to restore the availability of the services, but cannot guarantee a certain availability time.
4.3.1.3 Palmyra Klinik's services may be integrated with services from third parties such as e.g. apps, websites and near-body devices (so-called wearables, non-invasive as well as invasive), as well as content from third parties. For such third-party products, terms may apply in addition to what is stated in the Agreement.
4.3.1.4 Palmyra Klinik generates its own content and integrates content from third parties. Palmyra Klinik reserves the right to continuously make adjustments and changes to the content of the digital services.
4.3.2 App use/Create account
4.3.2.1 Palmyra Klinik's app works for the devices specified in the Apple AppStore and Google Play Store respectively.
4.3.2.2 The patient is responsible for creating an account for logging into Palmyra Klinik's app, and for keeping login details and passwords secure and never shared with anyone.
4.3.2.3 Palmyra Klinik reserves the right to terminate an account that has not been used for 12 months.
4.3.3 The Use of Your Device
4.3.3.1 By downloading Palmyra Klinik's app, the patient gives his consent for Palmyra Klinik's application to be installed and executed on that device, as well as to use other software, app or function for obtaining data from e.g. close-to-body units.
5 Price & Payment
5.1 Price
5.1.1 The price for the Service can be seen from the order confirmation or from the current price list at palmyraklinik.se.
5.1.2 Price changes for subscription services are announced in advance. If the Patient does not approve the price change, the Patient can cancel the subscription service until it ceases at the latest at the time when the price change takes effect. If the Patient continues to pay thereafter, the Patient is considered to have approved the new price/content.
5.1.3 Subscription services can only be paused after agreement with the responsible doctor and then for a maximum of 6 months.
5.1.4 Termination takes place via e-mail to info@palmyraklinik.se. Palmyra Klinik confirms the termination via e-mail.
5.2 Payment
5.2.1 Fees for the Service and options and payment options can be seen from the Service-specific terms or from the price list valid at any time on palmyraklinik.se. Payment terms 20 days net. In case of late payment, reminder fees and late payment interest are added according to law. The agreement may also be terminated.
5.3 Rebooking and cancellation
5.3.1 The patient can contact Palmyra Clinic on phone 072-322 66 61 to reschedule or cancel an appointment (at the clinic or online).
5.3.2 Refusals must be notified no later than 24 hours before the time of the booked meeting.
5.3.3 In the event of absence from a meeting or cancellation less than 24 hours before the booked time, SEK 1,000 will be charged for a visit with a doctor and SEK 500 for a visit with a nurse or health coach. Such debiting does not apply to so-called introductory conversation.
5.4 Right of withdrawal
5.4.1 The patient has, in accordance with the Distance Contracts Act ch. 2. § 10 right to terminate the Service (right of withdrawal) by notifying Palmyra Klinik within two (2) weeks after the Agreement was entered into. The right of withdrawal applies provided that the Patient has not started any clinical service or treatment according to the scope of the Service. If the right of withdrawal is exercised, the fees paid will be refunded. Canceled purchase can be notified via email to info@palmyraklinik.se. Palmyra Klinik confirms canceled purchase by phone.
6 Handling of data and personal data
6.1.1 Palmyra Klinik always processes the Patient's personal data in accordance with current legislation and Palmyra Klinik's privacy policy. https://www.palmyraklinik.se/integritetspolicy/
6.1.2 The patient agrees that Palmyra Klinik and other companies that are part of the same group register, store and use information about the patient.
6.1.3 The patient agrees that Palmyra Klinik stores, in accordance with current Swedish legislation, medical history which includes name, social security number, address, e-mail address, photo, lab results, journal entries, treatments (and other information that the patient has shared with Palmyra Klinik) in purpose of being able to follow up the Patient's activity and adapt the Patient's medical plan. Information that the patient himself shares with Palmyra Klinik's App, e.g. responses to forms or uploading of biometric data, are stored in the same.
6.1.4 The patient agrees to Palmyra Klinik storing anonymized medical history, biometric data and biochemical lab data for the purpose of improving clinical care, research and business development. Such data is stored indefinitely according to Palmyra Klinik's decision.
6.1.5 The patient has the right to access his medical history and can request that the part that does not have to be saved according to current law be deleted. Palmyra Klinik confirms receipt of such deletion request. However, patient data that has been anonymized in accordance with §6.1.4 will not be deleted as it cannot be linked to a specific patient.
6.1.6 All personnel participating in the patient's care have access to medical record information because they are obliged by law to document such information that they receive. This includes administrative staff who answer the phone or who handle test results, nurses who meet the Patient when the test is taken, and doctors and health coaches who the Patient meets at the reception or online for health talks. All personnel who come into contact with the Patient are subject to a duty of confidentiality. 6.1.7 Palmyra Klinik communicates clinical information with the Patient in personal meetings with the care team or via Palmyra Klinik's App, not via e-mail.
6.1.8 Coaching and tips for changing habits and behaviors are communicated via personal meetings with the care team and via the messaging function in the Palmyra Clinic App.
6.1.9 The patient agrees that Palmyra Klinik can use all forms of communication for marketing purposes, e.g. but not limited to, e-mail, SMS, MMS, push notifications to inform about and/or market their offer according to § 19 of the Marketing Act. The patient can withdraw their consent to receive marketing messages at any time by contacting Palmyra Klinik. Regardless, Palmyra Klinik reserves the right to be able to communicate changes to terms and conditions regarding the Service directly with the Patient. Palmyra Klinik saves all data relating to marketing for two years after the last order placed.
7 Force Majeure
7.1 Funmed is exempt from penalty for failure to fulfill its obligations under the Agreement if the failure is due to circumstances beyond Funmed's control and which Funmed should not reasonably have foreseen at the time of the conclusion of the Agreement, e.g. lightning, fire, natural disaster, epidemic, labor conflict, changed laws, regulations or government regulations, government interventions, general interruptions in data or telecommunications, and obstruction or delay of deliveries from subcontractors due to circumstances specified above.
8 Assignment
8.1 Funmed has the right to fully or partially transfer its rights and obligations under the Agreement to another company within the same group as Funmed.
9 Invalidity of provisions
9.1 Should any provision in the Agreement be invalid, this shall not affect other parts of the Agreement. Funmed shall, however, as far as possible, adjust the provision to give effect to its spirit.
10 Intellectual Property Rights
10.1 All ownership, copyright and all other rights to the Service, inventions, knowledge, methods, models and documentation, which are used and/or provided by Funmed and Funmed's company and brand, belong exclusively to Funmed. All copying, modification, transfer and/or other use of Funmed's material, which is not expressly permitted according to Funmed's instructions, is prohibited. Unauthorized use of Funmed's intellectual property rights may, in addition to constituting a violation of these General Terms and Conditions, be criminal. Funmed reserves the right to take legal action in the event of unauthorized use of Funmed's intellectual property rights.
11 Dispute
11.1 The Agreement and General Terms and Conditions shall be interpreted and applied in accordance with Swedish law. Disputes arising from the Agreement and General Terms and Conditions shall be settled at a general court with the Stockholm district court as the first instance.
11.2 The patient can submit any comments on the care directly to Funmed. The patient can also turn to the patient committee in their region or to the Inspectorate for Care and Care (IVO).
